Claims arising out of motor vehicle collisions are deictically based. Not all accidents on the road create a liability on the part of the road accident fund.
In many instances, a party would have a civil claim against the driver of the other vehicle.
This would include claims arising out of damages to his vehicle alone without any personal injury suffered.
Personal injury and death are compensated by the Road Accident Fund from accidents resulting from motor vehicle collisions on roads. Private roads and driveways are not included.
Drivers, passengers, cyclists and pedestrians are covered by the Road Accident Fund.
Legislation has produced the organ body called the Road Accident Fund which had previously been the task of the diverse insurance companies to compensate the injured.
